Objective

To promote the integrity of public governance, by specifying the principles and standards of conduct expected of all actors.
To encourage all actors to act in accordance with the law and serve the public interest.
To ensure all actors are accountable for their decisions and actions, and should be willing to give detailed grounds for these decisions.
To inspire relevant actors fostering transparency, openness, and visibility of their activities, including policy and decision making, communication, and participation.
To advocate that all actors shall respond diligently, honestly, and fully to any request for information from the public. They shall defend the right of everyone to hold, receive and impart such information without interference.
To urge all actors respect each other, and that they shall actively work towards a non-discriminatory culture of fairness and tolerance that appreciates diversity.
To promote all actors to show impartiality when taking decisions and actions, and avoid any form of prejudice and favouritism, including nepotism.

Impact

The European Commission appreciates the Committee's support for the proposal on combating corruption. The Commission acknowledges the Committee's recommendations for amendments including the importance of addressing corruption across all levels of government, including national, regional, and local. It agrees with the Committee on the significance of local and regional governments adopting Codes of Conduct. Additionally, the Commission welcomes the Committee's stance supporting the additional sanction of deprivation of the right to stand in elections. Ongoing discussions involve the Commission, the European Parliament, and the Council, with a focus on reaching an ambitious agreement.
The Commission welcomes the Committee’s support for the proposal for a Directive on combating corruption and its recognition of the
great harm that corruption can inflict on democracies. It also takes note of the Committee’s recognition that the proposal conforms to the
principles of subsidiarity and proportionality. Discussions concerning the proposal between the Commission, the European Parliament and the Council, are underway and the Commission looks forward to continuing to work constructively to reach an ambitious agreement in the near future. To that end, the Commission has taken due note of the Committee’s recommendations for amendments.
The Commission agrees that it is important to address, prevent and fight corruption at all levels of government, including the national, regional and local level. In this respect, it agrees with the Committee on the importance of local and regional governments adopting Codes of Conduct. It also welcomes the Committee’s position and support concerning the additional sanction of deprivation of the right to stand in election.
The Commission welcomes the Committee’s interest to participate in the work of the EU network against corruption and looks forward to
discussing possible forms of the Committee’s involvement in the network, in full agreement with the co-legislators.

Essential points

THE EUROPEAN COMMITTEE OF THE REGIONS

– stresses that the fight against corruption is essential in order to guarantee the rule of law;

– reiterates that corruption poses a major threat to local and regional governance and democracy in Europe and the fight against corruption is crucial to safeguarding the European democratic values as well as to protecting the healthy functioning and growth of the European Single Market;

– calls for addressing this threat at all levels of governance – local, regional, national and EU, as the citizens expect high standards of probity from public officials. Warns that corruption cases at EU level seriously undermine public trust in EU institutions;

– emphasises that comprehensive instruments already exist at international, European and national level to combat corruption but their effectiveness continues to be hampered by implementation and enforcement gaps and obstacles in cooperation which is where more effort is needed;

– highlights the European Code of Conduct for all Persons Involved in Local and Regional Governance adopted by the Congress of Local and Regional Authorities of the Council of Europe as an excellent example of making the fight against corruption a long-term priority for local and regional governments and their associations; points to Resolution 433(2018) in which the Congress invites local and regional authorities to adopt this Code themselves or to draw up and promote similar codes of conduct;

– calls on the promotion and the follow-up of this Code to be conducted jointly by the CoR and the Congress through an annual dialogue and a follow-up report as an effective tool to monitor the fight against corruption;

– recommends that local and regional authorities reflect on their own existing ethics and integrity frameworks and the use of a whole range of activities and tools in order to better combat any potentially corrupt practices and reinsure citizens of high ethical standards;

– calls on the local and regional authorities to take inspiration from the Code and guidelines proposed by the Congress and develop or revise their anti-corruption strategies and codes of conduct.
